How many days of leave do judges and prosecutors get per year in Türkiye?
In Turkey, the leave system for judges and prosecutors differs from that of classic civil servants and is governed by the Law No. 2802 on Judges and Prosecutors. The leave rights of judicial personnel are primarily implemented in two ways:
1. Judicial Vacation (Annual Break)
A large majority of judges and prosecutors take their annual leave collectively during the Judicial Vacation period.
- Duration: It begins on July 20 and ends on August 31 each year.
- Total Days: It lasts exactly 43 days.
- During this period, courthouses do not close completely; on-duty judges and prosecutors are on duty to ensure that urgent and pressing matters (detention reviews, expedited cases, etc.) are not disrupted. Judicial personnel on duty use their judicial vacation rights later.
2. Normal Annual Leave (Those Not Benefiting from Judicial Recess)
Judicial officers working in administrative positions within the Council of Judges and Prosecutors (HSK) or the Ministry of Justice (e.g., HSK inspectors, Ministry bureaucrats) or those who do not benefit from judicial recess due to special circumstances are entitled to normal annual leave.
- Duration: Judges and prosecutors in this situation are granted 30 days of annual leave, excluding normal travel time. * According to the law, a judge or prosecutor who benefits from judicial recess is not granted an additional annual leave entitlement for that year.
📌 Leave of Absence for Justifiable Reasons: In addition to annual leave/judicial recess rights, judges and prosecutors (and their candidates) also have the right to use a total of 10 days of leave of absence for justifiable reasons per year for urgent and necessary circumstances.
